CONSTITUTION OF INDIA AND WE, THE PEOPLE/PUBLIC OF INDIA...

(PLEASE READ CAREFULLY & COMMENT THEN.)

      As We all know & Honorable Supreme Court & High Courts also agreed that the PREAMBLE of the CONSTITUTION is the SOUL of our CONSTITUTION & contain the basic structure of our CONSTITUTION, which can not be amended in exercise of the power under article 368 of the Constitution.

AND 

That PREAMBLE said very firmly that,

"WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens : 

JUSTICE, ....;

LIBERTY .....;

EQUALITY ......;

....

FRATERNITY .......

.....;

..........

do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION."

   My inference in the clear light of this MANDATORY provisions of PREAMBLE OF OUR CONSTITUTION is that,

"WE, THE PEOPLE  OF INDIA i.e. BHARAT are more SUPREME than all the Constitutional Offices & their officers created and/or established by vivid provisions of this Constitution. Which infers that PARLIAMENT & THEIR ALL CONSTITUENTS, STATE ASSEMBLIES & THEIR ALL CONSTITUENTS, ALL स्वायत्त INSTITUTIONS (including All Courts, ECs, Officers of Central & State Governments, etc.) are inferior to the WE, PEOPLE OF INDIA. 

     THEN, all the SO CALLED PRIVILEGEs, CONTEMPTs etc. availed by abovementioned functionaries are also inferior to the PRIVILEGEs & CONTEMPTs of WE, THE PEOPLE OF INDIA, which are conferred by the CONSTITUTION itself. 

    In General speaking, we called PUBLIC instead of PEOPLE, But both the terms in its conceptual sense are same. HENCE my POSTULATE & THEOREM is that "WE, THE PEOPLE/PUBLIC OF INDIA ARE SUPREME to all other functionaries created and/or established under the vivid provisions of our CONSTITUTION."
